1. Who we are

These terms govern your use of Memory Assistant ("the Service"), an AI-powered personal memory app provided by Brandy Wolstenholme ("we", "us"). By creating an account or continuing to use the Service you agree to these terms.

2. Your account

You are responsible for keeping your login credentials confidential and for activity under your account. Provide accurate information and keep it up to date. You must be of legal age in your jurisdiction.

3. Acceptable use

You agree not to misuse the Service — including unlawful use, fraud or spam, infringing intellectual property, interfering with security (malware, probing, scraping), or attempting to reverse engineer or resell the Service.

4. Your content

You retain ownership of the memories and notes you save. You grant us a limited license to host, process and display that content solely to provide the Service to you and the household members you choose to share with.

5. Service and intellectual property

We retain ownership of the Service, its software, design and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. We do not guarantee uninterrupted or error-free performance.

6. Payments, billing and renewals

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellations and refunds are covered by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid period and you retain access until then.

7. AI outputs

Memory Assistant uses AI to categorize and answer questions about your memories. Outputs may be inaccurate or incomplete. Do not rely on them for legal, financial, medical or other professional decisions without independent verification. You are responsible for your prompts and how you use AI outputs.

8. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination we will provide a reasonable period to export your data before deletion.

9. Disclaimers and liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of merchantability or fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the 12 months preceding the claim. We exclude liability for indirect or consequential damages. Nothing limits liability for fraud, death or personal injury where excluded by law.

10. Changes

We may update these terms. Material changes will be communicated through the Service. Continued use after changes means you accept them.
